Practical vs. Legal - Getting Model and Property Releases
Depending on the circumstance, a model or property release may not be legally necessary. But getting one never hurts and it may help. It may make some people think that they can't sue you (they can, even if their cause of action is bogus). If they do sue you, having a release may shorten the litigation and it could help you win. Even when you win, though, your defense fees can be costly. Posted by Carolyn Wright

Presumption and the Lemon Law
You've heard the old adage, “If it looks like a duck, walks like a duck and quacks like a duck, it's a duck. We would say, you might presume it's a duck. Sure, there's an outside chance it's an albino spoonbill chicken disguised as a duck, but don't bet your next paycheck on it. Posted by Donald Ladew

Protecting and Prosecuting Your Images
When your image is used without your permission, your copyright is infringed. Protecting and prosecuting your images go hand-in-hand. If you don't protect them, you can't prosecute them. If you don't prosecute them, then infringers will continue to take advantage of artists, and soon you won't be able to protect your images. Posted by Carolyn Wright

Protection for Your Derivative Works
Here's the issue: you photograph a car for the manufacturer in 2004 and
register the photo with U.S. Copyright Office. In 2005, the car maker
produces the same car except with a different style of wheels. The client
asks you to shoot only the new wheels and add them to the original
photo using Photoshop. The new photo then will be distributed. Do you
need to register the new photograph to obtain full statutory copyright
protection? You do if it would qualify as a derivative work. Posted by Carolyn Wright

Railroad Accident Lawyer Says: Buckle Your Seatbelts
Massive train crashes seem the dramatic stuff of movies and novels, billowing steam engines destined for disaster, fixed irreversibly on track to collide. Indeed, in the 19th century train companies used head-on train collisions as a publicity stunt. The Crush Crash in Waco, Texas drew so many observers that Waco became, for one night, the second largest city in the state. Perhaps modern day railroads do not encounter anything so catastrophic as the rerouted steam locomotive that caused a mountain to collapse in Ayn Rand's Atlas Shrugged, but train crashes are still a major problem in the United States. Train crashes injure more than 500 people every year. Posted by Anna Henningsgaard

Separate But Equal Legacy of Chief Justice Bill Rehnquist
Most White Americans have no idea that Chief Justice Bill Rehnquist, while he served as a law clerk to Justice Robert Jackson in 1952-53, wrote a legal memo defending the old and reviled "separate but equal" doctrine. But Black Americans are well aware that Rehnquist espoused beliefs that would have kept them out of public schools, out of public colleges and universities, using filthy and cracked public toilets, drinking out of separate water fountains, etc. Rehnquist's voting record on the court speaks louder than any excuses offered during his confirmation hearings. He has sought to gut the holding of Brown v. Board, whenever possible, as with other civil rights holdings, including the important Miranda warnings that police officers must give suspects upon detaining them. Posted by Dr. Michael A. S. Guth
